Elections Board Dismisses Cates' Complaint

The Illinois State Board of Elections has dismissed a complaint filed by Judy Cates, the Democratic nominee for the 5th District Appellate Court, who claimed her Republican opponent had failed to disclose two campaign contributions.
In her complaint, the Swansea attorney alleged that St. Clair County Circuit Judge Steve McGlynn, the Republican nominee for the appellate court seat, had failed to disclose a $10,000 campaign contribution from the Illinois State Medical Society's political action committee, as well as an in-kind contribution for the use of a private airplane owned by Luhr Brothers, a Columbia construction company.
In an order dated Nov. 1 and signed by ISBE Chairman William M. McGuffage, the board found regarding the allegation that McGlynn failed to report the $10,000 cash donation that "the complaint was not filed upon justifiable grounds."
The board said the same thing regarding Cates' complaint about the in-kind contribution from Luhr Brothers.
"The complaint is dismissed, and no further action regarding it need be taken," the order stated. "The dismissal does not preclude State Board of Elections staff from determining whether the reporting of the in-kind contribution was timely and to assess a penalty, if warranted."
